General Terms and Conditions of Sale

1. Scope of application

The following general terms and conditions apply to all orders placed through our online shop by consumers and professionals.

A consumer is a natural person who acts for purposes unrelated to their business, commercial, craft or professional activity, if any. A professional is a natural or legal person who acts in the exercise of their business, commercial, craft or professional activity.

For professionals: These general conditions prevail over any contradictory or conflicting general conditions prepared by the contracting professional. Such additional or contradictory conditions may be admitted as an integral part of the contract only with our explicit consent.

2. Contracting party, formation of contract, technical means for correction

The purchase agreement is concluded with Agriturismo Sant'Egle s.s..

The active display of products in our online shop constitutes a binding invitation from us to submit a binding offer for said products. The consumer can therefore add products to the shopping cart, non-bindingly, and correct their data at any time before submitting the binding order, using the correction tools provided and described in the order process. The contract becomes binding upon its conclusion, which is deemed to be concluded when the offer for the goods in the shopping cart is accepted by clicking the purchase button. Immediately after placing the order, the consumer receives an additional confirmation email.

Technical means for correction
With reference to the technical means made available to the Customer to identify and correct any data entry errors before submitting the order, the remote contract conclusion system of the shop allows following a guided procedure that at any time allows checking and then validating the entered information and correcting any errors before sending the electronic order.

3. Contract language, storage of contract text

The language(s) available for concluding the contract is/are the following: Italian, German, English, French, Russian.

We store the contract text and send the order details along with the general terms and conditions in written form. For security reasons, the contractual content will no longer be accessible via the Internet.

4. Delivery methods

The indicated sales prices do not yet include shipping costs.

Shipping cost is €5.90. Free for orders over €99 in Italy. In Europe, shipping cost is €15, free for orders over €250.

Delivery is possible through shipping services or collection of goods at our organic shop, which is open every morning from 8:30 AM to 12:30 PM. It is always advisable to call +39 3294250285 before coming.

5. Payment

The following payment methods are available in our shop:

Advance payment (Bank transfer)
If you choose to pay by bank transfer, we will send you our bank details via a separate electronic message. The goods will be shipped only after the full amount has been credited.

Credit card
You must enter your credit card details when placing the order.
After successful authentication of the actual cardholder, the payment transaction is carried out automatically immediately after the shipping process begins.

Poste Pay

Poste Italiane circuit cards are only accepted by PayPal. For this reason, those with a Poste Pay card must select PayPal, even if they do not have a PayPal account to pay for the order.

PayPal, PayPal Express
During the order process, you will be redirected to the online provider PayPal's website. To pay the amount via PayPal, you must be registered with the provider or register first, log in with your access data, and confirm the payment mandate in our favour. After the order is concluded, we will ask PayPal to initiate the payment operation.
Immediately afterwards, the payment operation is carried out automatically by PayPal. Further instructions can be found within the order process.

6. Right of withdrawal

You have the right of withdrawal as specified in the withdrawal policy.

7. Retention of title

The goods remain our property until full payment.
For professionals, the following also applies: we reserve ownership of the goods until full payment of all claims arising from the current business relationship. You are granted the right to resell the goods subject to retention of title in the ordinary course of business; regardless of any merger or commingling of the goods subject to retention of title, all claims arising from the aforesaid sale are deemed to be assigned equal to the actual invoiced amount, and this assignment is accepted by us. You remain authorized to collect the claims, however, we can also collect the claims, provided you are in default with us.

8. Transport damages

Parcels travel at the buyer's risk. We recommend always signing WITH SPECIFIC RESERVATION to be reimbursed in case of damage to the parcel by the courier.
It is possible to insure the parcel against any breakages or damages, with full reimbursement of the value of the goods shipped.
Otherwise, couriers, protected by law, in case of damage to the parcel, only reimburse €1/kg, excluding shipping costs.

9. Shipping times and storage

Shipments are made from Monday to Friday, by 10 AM. Couriers do not work on weekends.

We ship with express courier at a cost of €5.90 throughout Italy (Sicily and Sardinia included) and FREE for orders over €99 in Italy. 

For smaller islands and Venice Lido, the cost is €15. Alternatively, you can send your own cheaper courier to collect.

Delivery times:

cities 1-2 days, provinces 2-3 days, islands 3-5 days, smaller islands 3-5 days, Europe 5-7 days.

During the evening of the shipping day, you will receive the package track via email/SMS/WhatsApp from the courier, with all information on the day and estimated time slot for delivery.

On the courier's website, you can track where the package is located.

BEFORE CALLING US, PLEASE, CHECK THIS INFORMATION YOURSELF.

If the courier does not find you at home, they will attempt delivery again the next day.
The shipping cost includes a maximum of 1 day of storage.
If you do not collect the package within the expected time, BRT will charge you storage fees.

If the storage fees are not paid, the package will be returned to the sender and the costs will be charged to the recipient or deducted from the value of the goods.

10. Statutory warranty of conformity and commercial warranties

The statutory warranty of conformity applies as provided by law. To check for additional commercial warranties and their applicable conditions, please refer to the product page or sheet, or to the specific information pages.

Unless otherwise explicitly agreed upon in writing between the parties, the statutory warranty of conformity applies as provided by law.
In the case of used goods, the following applies: the statutory warranty of conformity is excluded in cases where the defect occurred after the item was opened or after its expiry date.
For entrepreneurs, the forfeiture period for asserting defects concerning goods before their expiry date.
In the event that the supplied item is defective, we guarantee, at our discretion, for professionals, the elimination of the defect (restoration of conformity) or the supply of a defect-free item (replacement).

11. Returns

If you are not satisfied with the goods, you can return them at your own expense.

Once the goods' intact condition has been verified, only the amount of the goods will be refunded, excluding shipping costs.

12. Dispute Resolution

The European Commission provides an online platform for dispute resolution, which can be found at the following website: https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in conciliation proceedings before a consumer dispute resolution body.
